Une personne doit obtenir un permis pour chaudières et équipements à pression (CEP) pour changer l’emplacement d’une chaudière, d’un système de chaudières ou d’un appareil à pression non portatif.
Résumé
Les nombreuses règles et licences établies pour travailler avec des chaudières, des appareils à pression et d’autres systèmes de pression existent pour garantir la santé et la sécurité de tous. Une personne doit obtenir un permis CEP pour construire, installer, modifier, réparer une chaudière ou un appareil à pression ou y faire des ajouts. Elle doit également obtenir un permis CEP pour changer l’emplacement d’une chaudière, d’un système de chaudières ou d’un appareil à pression non portatif. [N.S. Reg. 10/2011, s. 33(1)]
Le présent sujet couvre les permis, licences et certificats associés aux chaudières et aux appareils à pression.
Permis CEP
Une personne est tenue de faire ce qui suit :
- Obtenir un permis CEP pour : [N.S. Reg. 10/2011, s. 33(1)]
- construire une chaudière ou un appareil à pression;
- installer une chaudière ou un appareil à pression;
- modifier, réparer une chaudière ou un appareil à pression ou y faire des ajouts;
- changer l’emplacement d’une chaudière, d’un système de chaudières ou d’un appareil à pression non portatif.
Exceptions au permis
- Le permis CEP n’est pas nécessaire pour l’entretien courant ou la révision d’un composant d’un système à pression si toutes les conditions suivantes sont remplies : [N.S. Reg. 10/2011, s. 33(2)]
- L’entretien courant ou la révision est inclus dans le programme de qualité du titulaire de la licence d’entrepreneur de CEP, pour la chaudière ou l’appareil à pression ou pour les travaux réglementés.
- Un programme de qualité pour le système à pression a été déposé et accepté par le responsable de l’inspection en chef de CEP (voir la section « Programme de qualité du titulaire de la licence d’entrepreneur de CEP »).
- Le propriétaire d’une chaudière ou d’un appareil à pression n’a pas besoin d’obtenir un permis CEP pour l’installation d’une chaudière ou d’un appareil à pression si les critères suivants sont satisfaits : [N.S. Reg. 10/2011, s. 33(4)]
- L’installation s’inscrit dans la portée de la loi sur les chaudières à vapeur et les appareils à pression (Steam Boiler and Pressure Vessel Act) et du règlement y afférent (Steam Boiler and Pressure Vessel Regulations) pris en application de cette Loi et est autorisée aux termes de ceux-ci.
- L’installation a eu lieu avant la date d’entrée en vigueur du règlement sur les chaudières et les appareils à pression (Boiler and Pressure Equipment Regulations – en anglais seulement) (N.S. Reg. 10/2011) came into force, April 1, 2011.
Demande de permis
- Soumettre la demande de permis CEP avec le paiement des frais connexes et : [N.S. Reg. 10/2011, s. 34(1)]
- une description écrite des travaux réglementés à effectuer;
- les plans des travaux réglementés à effectuer;
- les caractéristiques des machines et des composants à utiliser;
- le numéro de licence d’entrepreneur de CEP de la personne qui soumet la demande.
- Les permis CEP ne peuvent être accordés qu’aux titulaires d’une licence d’entrepreneur de CEP. [N.S. Reg. 10/2011, s. 34(2)]
- Avant d’accorder un permis CEP, le responsable de l’inspection en chef de CEP doit voir et approuver tous les dessins des travaux réglementés à effectuer. [N.S. Reg. 10/2011, s. 34(3)]
- Le responsable de l’inspection en chef de CEP peut imposer toute condition qu’il juge nécessaire à un permis CEP. [N.S. Reg. 10/2011, s. 34(4)]
Expiration et renouvellement
- Un permis CEP est valable jusqu’à la date d’expiration indiquée sur le permis, sauf s’il est suspendu ou révoqué plus tôt par le responsable de l’inspection en chef de CEP. [N.S. Reg. 10/2011, s. 36(1)]
- Pour demander à nouveau un permis CEP expiré ou sur le point d’expirer, le titulaire du permis peut soumettre le numéro du permis CEP et tous les renseignements requis énumérés dans la section « Demande de permis CEP ». [N.S. Reg. 10/2011, s. 36(2)]
Utilisation d’un permis CEP
Le titulaire du permis CEP doit faire ce qui suit :
- Afficher le permis CEP correspondant sur le site où les travaux réglementés sont effectués. [N.S. Reg. 10/2011, s. 35]
- Aviser le responsable de l’inspection en chef de CEP une fois que les travaux réglementés autorisés par le permis CEP sont terminés. [N.S. Reg. 10/2011, s. 37]
Les permis CEP ne sont pas transférables et ne peuvent être utilisés que par le titulaire de la licence d’entrepreneur de CEP à qui le permis a été délivré. [N.S. Reg. 10/2011, s. 38]
Déplacement de l’équipement
Le propriétaire ou le fournisseur d’une chaudière, d’un système de chaudières ou d’un appareil à pression non portatif doit faire ce qui suit :
- Aviser le responsable de l’inspection en chef de CEP au plus tard 30 jours après que la chaudière, le système de chaudières ou l’appareil à pression non portatif a été retiré de son emplacement initial s’il est déplacé : [N.S. Reg. 10/2011, s. 39(1)]
- de la Nouvelle-Écosse à un autre endroit en Nouvelle-Écosse;
- ou de l’extérieur de la Nouvelle-Écosse à un endroit en Nouvelle-Écosse.
- Fournir les renseignements suivants dans son avis de déplacement : [N.S. Reg. 10/2011, s. 39(2)]
- Toutes les données de conception et de fabrication de la chaudière ou de l’appareil à pression qui est déplacé [N.S. Reg. 10/2011, s. 39(2)(a)]
- L’un des éléments suivants : [N.S. Reg. 10/2011, s. 39(2)(b)]
- Un dossier d’inspection annuelle, un dossier d’entretien, de réparation, de modification et de perturbation. [N.S. Reg. 10/2011, s. 39(2)(b)(i)] ou
- Un certificat d’inspection préparé au cours des six mois précédant l’entrée de la chaudière ou de l’appareil à pression en Nouvelle-Écosse, signé par un responsable de l’inspection de chaudières employé par l’administration compétente de la province ou du pays où la chaudière, le système de chaudières ou l’appareil à pression non portatif se trouvait à l’origine, et comportant les détails suivants : [N.S. - Une inspection interne
- Une inspection externe
- Un essai de pression à au moins la pression de service maximale autorisée
Licence d’équipement
- Une personne doit être titulaire d’une licence d’équipement pour utiliser ou faire fonctionner une chaudière, un appareil à pression ou une installation frigorifique. [N.S. Reg. 10/2011, s. 40]
Demande de licence d’équipement
- Soumettre une demande de licence d’équipement avec le paiement des frais connexes et : [N.S. Reg. 10/2011, s. 41]
- une description écrite de la chaudière, de l’appareil à pression ou de l’installation frigorifique à exploiter;
- l’emplacement de la chaudière, de l’appareil à pression ou de l’installation frigorifique à exploiter;
- le numéro de permis CEP pour la fabrication ou l’installation de la chaudière, de l’appareil à pression ou de l’installation frigorifique.
Expiration et renouvellement
- Une licence d’équipement est valable jusqu’à la date d’expiration indiquée sur la licence, sauf si elle est suspendue ou révoquée plus tôt par le responsable de l’inspection en chef de CEP. [N.S. Reg. 10/2011, s. 43(1)]
- Pour redemander une licence d’équipement expirée ou sur le point d’expirer, le titulaire de la licence d’équipement doit soumettre le numéro de la licence d’équipement et tous les renseignements requis énumérés dans la section « Demande de licence d’équipement ». [N.S. Reg. 10/2011, s. 43(2)]
Utilisation d’une licence d’équipement
Le titulaire de la licence d’équipement doit afficher la licence d’équipement avec la chaudière, l’appareil à pression ou l’installation frigorifique que la licence autorise le titulaire de la licence d’équipement à exploiter ou à un autre endroit approuvé par le responsable de l’inspection en chef de CEP. Une licence d’équipement n’est pas transférable et ne peut être utilisée que par la personne à qui elle est accordée. [N.S. Reg. 10/2011, s. 44]
Licence d’entrepreneur de CEP
Une personne doit s’assurer de ce qui suit :
- Détenir une licence d’entrepreneur de CEP pour effectuer l’un des travaux réglementés suivants : [N.S. Reg. 10/2011, s. 45]
- Travailler en tant qu’entreprise fabricante, personne chargée de la construction ou de l’installation ou bien entrepreneur sur une chaudière ou un appareil à pression.
- Effectuer des travaux de réparation ou de modification sur une chaudière ou un appareil à pression.
- Effectuer le soudage par pression sur une chaudière ou un appareil à pression.
- Réaliser des tests de compétence pour soudage par pression.
- Travailler au sein d’une organisation chargée de fabriquer, d’installer, de réparer ou de modifier une chaudière ou un appareil à pression.
Le responsable de l’inspection en chef de CEP peut imposer toute condition à la licence d’un entrepreneur de CEP qu’il juge nécessaire. [N.S. Reg. 10/2011, s. 47(2)]
Demande de licence d’entrepreneur de CEP
- Soumettre la demande de licence d’entrepreneur de CEP avec le paiement des frais correspondants ainsi qu’un programme de qualité pour tout produit ou travail réglementé que l’entrepreneur effectuera. [N.S. Reg. 10/2011, s. 47(1)]
Expiration et renouvellement
- Une licence d’entrepreneur de CEP est valable jusqu’à la date d’expiration indiquée sur la licence, sauf si elle est suspendue ou révoquée plus tôt par le responsable de l’inspection en chef des chaudières et équipements à pression. [N.S. Reg. 10/2011, s. 54(1)]
- Pour demander à nouveau une licence d’entrepreneur de CEP expirée ou sur le point d’expirer, l’entrepreneur de CEP peut soumettre le numéro de la licence et tous les renseignements requis énumérés dans la section « Demande de licence d’entrepreneur de CEP ». [N.S. Reg. 10/2011, s. 54(2)]
Utilisation d’une licence d’entrepreneur ou de CEP
Le titulaire d’une licence d’entrepreneur de CEP doit faire ce qui suit :
- Présenter sa licence aux fins d’examen, sur demande du responsable de l’inspection de CEP. Si la personne ne présente pas de licence d’entrepreneur de CEP lorsqu’on la lui demande, on suppose jusqu’à preuve du contraire qu’elle n’est pas titulaire d’une licence d’entrepreneur de CEP. [N.S. - Tenir le responsable de l’inspection en chef de CEP informé de la portée des travaux réglementés effectués dans le cadre de sa licence. [N.S. Reg. 10/2011, s. 48]
Une licence d’entrepreneur de CEP n’est pas transférable et ne peut être utilisée que par la personne à qui elle est accordée. [N.S. Reg. 10/2011, s. 55]
Programme de qualité des titulaires de licences d’entrepreneur de CEP
Le titulaire d’une licence d’entrepreneur de CEP doit faire ce qui suit : [N.S. Reg. 10/2011, s. 53]
- Mettre en œuvre le programme de qualité accepté à la satisfaction du responsable de l’inspection en chef de CEP.
- Soumettre au responsable de l’inspection en chef de CEP un programme de qualité pour tout produit réglementé ou travail réglementé à effectuer et le faire accepter par le responsable de l’inspection en chef de CEP. S’assurer que le programme de qualité comprend :
- un manuel écrit où sont consignées toutes les mesures prises dans le cadre du programme;
- un procédé permettant de suivre l’historique d’une personne exerçant un métier de soudage par pression en cas de tâches de soudage par pression; un journal de l’historique des personnes exerçant un métier de soudage par pression peut être créé et tenu à jour pour chaque personne afin de garantir la continuité et l’exécution du test de compétence requis.
Soudage par pression
L’employeur de la personne exerçant le métier de soudage par pression doit faire ce qui suit :
- Être titulaire d’une licence d’entrepreneur de CEP. [N.S. Reg. 10/2011, s. 51(1)]
- S’assurer qu’un membre du personnel n’effectue pas de soudage par pression, à moins que : [N.S. Reg. 10/2011, s. 51(2)]
- le membre du personnel soit titulaire d’une licence accordée à une personne exerçant le métier de soudage par pression qui autorise le travail réglementé;
- le nom de l’employeur est celui qui figure sur la licence à l’intention d’une personne exerçant le métier de soudage par pression.
- Ne pas autoriser le soudage par pression d’un produit réglementé à moins que : [N.S. Reg. 10/2011, s. 51(3)]
- la personne exerçant le métier de soudage par pression soit titulaire d’une licence de la catégorie appropriée, sauf : [N.S. Reg. 10/2011, s. 56(1)] [N.S. Reg. 10/2011, s. 56(2)]
- si elle est réputée détenir une licence aux termes de l’article 52 de la loi sur la sécurité technique (Technical Safety Act),
- si elle travaille exclusivement comme personne opérant une soudeuse sur des équipements entièrement automatiques;
- la licence pour soudage par pression porte sur l’une des deux catégories suivantes : [N.S. Reg. 10/2011, s. 57]
- Licence pour soudage par pression (plaque de pression)
- Licence pour soudage par pression (tuyauterie sous pression)
- la licence pour soudage par pression contienne les renseignements suivants : [N.S. Reg. 10/2011, s. 58]
- Catégorie de la licence
- Portée des travaux autorisés par la licence, y compris les méthodes de soudage, les procédés, les positions et les plages d’épaisseur
- Nom de l’employeur de la personne exerçant le métier de soudage par pression pour lequel le titulaire de licence est autorisé à effectuer des travaux de soudage par pression
- Toutes les modalités ou conditions de la licence
- la personne exerçant le métier de soudage peut présenter sa licence de soudage par pression aux fins d’examen sur demande du responsable de l’inspection de CEP. [N.S. Reg. 10/2011, s. 59]
Test de compétence en soudage par pression
L’employeur de la personne exerçant le métier de soudage par pression doit faire ce qui suit :
- Effectuer un test de compétence de soudage par pression pour chaque membre du personnel qui demande une licence pour effectuer des travaux de soudage par pression. [N.S. Reg. 10/2011, s. 50(1)]
- Effectuer le test de compétence pour soudage par pression conformément à la procédure de soudage par pression enregistrée auprès de l’employeur de la personne exerçant le métier de soudage par pression (voir la section « Procédure de soudage par pression »). [N.S. Reg. 10/2011, s. 50(1)] [N.S. Reg. 10/2011, s. 60(2)(d)]
- S’assurer que le test de compétence pour soudage par pression se déroule en présence d’un témoin et que les résultats sont approuvés par un responsable de l’inspection de CEP. [N.S. Reg. 10/2011, s. 50(1)] [N.S. Reg. 10/2011, s. 60(2)(c)]
- Enregistrer les résultats des tests sur la demande dans un format défini par le responsable de l’inspection en chef de CEP. [N.S. Reg. 10/2011, s. 60(2)(a)]
- Effectuer le test de compétence pour soudage par pression avant d’établir un journal de l’historique de la personne exerçant le métier de soudage par pression pour la personne ayant soumis la demande. [N.S. Reg. 10/2011, s. 60(2)(b)]
- S’assurer que le test de compétence pour soudage par pression est effectué conformément aux normes de CEP et que les méthodes, procédés, positions et plages d’épaisseur de soudage sont conformes à ceux requis pour les travaux réglementés que l’employeur est autorisé à effectuer. - Conserver les dossiers des tests de compétence de la personne exerçant le métier de soudage par pression et les présenter à un responsable de l’inspection de CEP sur demande. [N.S. Reg. 10/2011, s. 50(2)]
Procédure de soudage par pression
L’employeur de la personne exerçant le métier de soudage par pression doit faire ce qui suit :
- S’assurer qu’une procédure de soudage par pression est en place et répond aux exigences cidessous. [N.S. Reg. 10/2011, s. 49(1)]
- S’assurer que la procédure de soudage par pression est préparée, mise à l’essai et certifiée conformément aux normes de CEP et enregistrée auprès du responsable de l’inspection en chef de CEP. [N.S. Reg. 10/2011, s. 49(2)]
- S’assurer que le responsable de l’inspection en chef de CEP approuve la méthode de soudage par pression si celle-ci est préparée en Nouvelle-Écosse. [N.S. Reg. 10/2011, s. 49(3)]
- S’assurer que la méthode de soudage par pression est approuvée par l’autorité compétente de cette province ou de ce pays si la méthode est préparée à l’extérieur de la Nouvelle-Écosse et soumettre le dossier de l’approbation au responsable de l’inspection en chef de CEP. Demande de test de compétence pour soudage par pression
Licence de plaque de pression
Les personnes se portant candidates au test de compétence pour soudage par pression doivent faire ce qui suit :
- Payer les frais applicables aux CEP et fournir une preuve satisfaisante pour le responsable de l’inspection en chef de CEP indiquant que : [N.S. Reg. 10/2011, s. 61]
- la personne se portant candidate est employée par l’employeur qui détient une licence d’entrepreneur de CEP; [N.S. Reg. 10/2011, s. 62]
- la personne se portant candidate possède l’une des qualifications suivantes : [N.S. Reg. 10/2011, s. 62]
- Détient un statut de compagne ou de compagnon en soudage ou un certificat de qualification en soudage du Programme des normes interprovinciales Sceau rouge délivré par le Conseil canadien des directeurs de l’apprentissage.
- A terminé avec succès un programme menant à un diplôme en soudage reconnu par le responsable de l’inspection en chef de CEP.
- A acquis une expérience pratique d’au moins un an en soudage.
- A obtenu une qualification en soudage d’un organisme de certification reconnu pour les essais de soudage ou d’une autorité compétente pour toutes les méthodes et tous les procédés de soudage, toutes les positions et toutes les plages d’épaisseur pour lesquels elle demande à être testée.
Licence de tuyauterie sous pression
Les personnes se portant candidates au test de compétence pour soudage par pression doivent faire ce qui suit :
- Payer les frais applicables de CEP et fournir une preuve satisfaisante pour le responsable de l’inspection en chef de CEP indiquant que : [N.S. Reg. 10/2011, s. 63]
- la personne se portant candidate est employée par l’employeur qui détient une licence d’entrepreneur de CEP; [N.S. Reg. 10/2011, s. 64]
- la personne se portant candidate possède l’une des qualifications suivantes : [N.S. Reg. 10/2011, s. 64]
- A réussi un test préliminaire de compétence pour soudage effectué par un responsable de l’inspection de CEP.
- Possède l’une des qualifications pratiques et pédagogiques suivantes :
- Détient un statut de compagne ou de compagnon en soudage ou un certificat de qualification en soudage du Programme des normes interprovinciales Sceau rouge délivré par le Conseil canadien des directeurs de l’apprentissage.
- A suivi avec succès un cours de soudage de tuyauterie sous pression reconnu par un organisme de certification reconnu.
- A acquis au moins deux ans d’expérience pratique en soudage, notamment en soudage à fond ouvert. ou
- A obtenu une qualification en soudage de tuyauterie sous pression d’un organisme de certification reconnu pour les essais de soudage ou d’une autorité compétente pour toutes les méthodes et tous les procédés de soudage, toutes les positions et toutes les plages d’épaisseur pour lesquels elle demande à être testée.
Demande de licence accordée à une personne exerçant le métier de soudage par pression
Un entrepreneur de CEP peut demander au responsable de l’inspection en chef de CEP, au nom d’un membre du personnel, une licence accordée à une personne exerçant le métier de soudage par pression pour ce membre du personnel. [N.S. Reg. 10/2011, s. 65(1)]
Les personnes qui soumettent une demande en vue d’obtenir une licence permettant d’exercer le métier de soudage par pression doivent faire ce qui suit :
- Réussir un test de compétence pour soudage par pression pour la catégorie et les méthodes de soudage, les procédés, les positions et les plages d’épaisseur qui font partie du champ d’exercice de la licence pour laquelle elles soumettent une demande. [N.S. Reg. 10/2011, s. 60(1)]
- Inclure les frais applicables de CEP et : [N.S. Reg. 10/2011, s. 65(2)]
- la preuve que la personne a réussi un test de compétence pour soudage par pression pour la catégorie et les méthodes de soudage, les procédés, les positions et les plages d’épaisseur qui seront inclus dans la portée de la licence demandée;
- le nom de l’employeur de la personne exerçant le métier de soudage par pression et le numéro de licence d’entrepreneur de CEP de l’employeur.
- Exemption : Une personne exerçant le métier de soudeuse, de braseuse ou d’opératrice de machines à souder qualifié aux termes de la loi sur les chaudières à vapeur et les appareils à pression (Steam Boiler and Pressure Vessel Act) et du règlement y afférent (Steam Boiler and Pressure Vessel Regulations) à la date d’entrée en vigueur du règlement (1er avril 2011) est exemptée de l’obligation de passer un test de compétence pour soudage par pression si sa demande comprend, en plus des renseignements requis ci-dessus : [N.S. Reg. 10/2011, s. 65(3)]
- la qualification existante de la personne;
- une preuve satisfaisante pour le responsable de l’inspection en chef de CEP que la personne possède une expérience égale à celle requise pour un test de compétence pour soudage par pression dans la catégorie et dans toutes les méthodes et tous les procédés de soudage et pour chaque position et plage d’épaisseur à inclure dans la portée de la licence demandée.
Remarque : Le responsable de l’inspection en chef de CEP doit fournir à l’employeur de la personne exerçant le métier de soudage par pression dont le nom figure sur la licence d’une carte contenant des renseignements sur la licence afin que l’employeur puisse faire une copie de la carte avant de la remettre à la personne exerçant le métier de soudage par pression. Expiration et renouvellement
- Une licence pour soudage par pression est valable jusqu’à la date d’expiration indiquée sur la licence, sauf si elle est suspendue ou révoquée plus tôt par le responsable de l’inspection en chef des chaudières et équipements à pression. [N.S. Reg. 10/2011, s. 68(1)]
- Le titulaire d’une licence d’entrepreneur de CEP peut demander le renouvellement de la licence pour soudage par pression d’un membre du personnel. [N.S. Reg. 10/2011, s. 68(2)]
Utilisation d’une licence pour soudage par pression
Une personne exerçant le métier de soudage par pression doit faire ce qui suit :
- Ne pas effectuer de soudage par pression pour un employeur autre que celui dont le nom figure sur sa licence. [N.S. Reg. 10/2011, s. 67(1)]
- Si une personne exerçant le métier de soudage par pression veut changer l’employeur dont le nom figure sur sa licence, le titulaire de la licence d’entrepreneur de CEP qui est le nouvel employeur doit demander le changement au responsable de l’inspection en chef de CEP au nom de la personne exerçant le métier de soudage par pression.
- Cette demande doit indiquer les méthodes et procédés de soudage, les positions et les plages d’épaisseur nécessaires pour les travaux réglementés que son entreprise est autorisée à effectuer. [N.S. Reg. 10/2011, s. 67(2)-(3)]
- Présenter sa licence pour soudage par pression aux fins d’examen sur demande d’un responsable de l’inspection de CEP. Si elle ne présente pas une licence pour soudage par pression contenant le nom de l’employeur de la personne exerçant le métier de soudage par pression et correspondant à la catégorie et à la portée des travaux effectués, il est présumé jusqu’à preuve du contraire que la personne n’est pas titulaire de la licence appropriée pour les travaux. - Un responsable de l’inspection de CEP peut demander à une personne exerçant le métier de soudage par pression de repasser un test de compétence pour soudage par pression s’il a des doutes quant à la qualité de son travail. [N.S. Reg. 10/2011, s. 60(3)]
Les licences pour soudage par pression ne sont pas transférables et ne peuvent être utilisées que par la personne à qui la licence a été accordée. [N.S. Reg. 10/2011, s. 69]
Contrôle par le responsable de l’inspection de CEP des travaux de soudage par pression
Un responsable de l’inspection de CEP peut exiger un examen non destructif de toute soudure par pression ou du travail d’une personne exerçant le métier de soudage par pression s’il estime que la qualité de la soudure est incertaine. [N.S. Reg. 10/2011, s. 52(1)]
Le titulaire d’une licence d’entrepreneur de CEP doit faire ce qui suit :
- Réparer et vérifier la qualité d’une soudure défectueuse déterminée par un examen non destructif avec d’autres essais non destructifs jusqu’à ce qu’un responsable de l’inspection de CEP soit satisfait de la qualité de la soudure. [N.S. Reg. 10/2011, s. 52(2)]
Certificat de compétence de CEP (Inspections)
Une personne doit être titulaire d’un certificat de compétence de CEP (Inspections) pour être responsable de l’inspection de chaudières et effectuer le travail réglementé d’inspection pour la certification des chaudières, des appareils à pression ou des systèmes de tuyauterie sous pression. La personne qui demande un certificat de compétence de CEP (Inspections) doit faire ce qui suit :
- Payer tous les frais applicables aux CEP.
- Fournir au responsable de l’inspection en chef de CEP la preuve qu’elle possède une formation et une expérience suffisantes en matière d’équipements à pression. [N.S. Reg. 10/2011, s. 71]

- Être employée par l’un des organismes suivants : [N.S. Reg. 10/2011, s. 72(a)]
- Gouvernement de la Nouvelle-Écosse ou autorité reconnue ayant compétence dans une administration à l’extérieur de la Nouvelle-Écosse
- Compagnie d’assurance qui propose une couverture d’assurance pour les chaudières ou
- Propriétaire ou personne qui utilise un produit réglementé qui a mis en œuvre un programme de qualité enregistré auprès du gouvernement de la Nouvelle-Écosse
- Elle doit également satisfaire à l’une des exigences suivantes en matière d’expérience : [N.S. Reg. 10/2011, s. 72(b)]
- Détenir une commission de la National Board of Boiler and Pressure Vessel Inspectors (NBBI) ou une certification API 510 de l’American Petroleum Institute (API) qui a été délivrée dans les cinq années précédant immédiatement sa demande.
- Avoir réussi l’examen de la commission de la NBBI ou le processus de certification API 510 dans les cinq années précédant immédiatement sa demande.
- Avoir été reconnue comme responsable de la sécurité des normes relatives aux chaudières par une autorité compétente à l’extérieur de la Nouvelle-Écosse au cours des cinq années précédant immédiatement sa demande.
Conditions d’obtention d’un certificat de compétence de CEP (Inspections)
- Un certificat de compétence de CEP (Inspections) est valable sauf s’il est suspendu ou révoqué par le responsable de l’inspection en chef de CEP. [N.S. Reg. 10/2011, s. 74(1)]
- Le responsable de l’inspection en chef de CEP peut refuser d’accorder un certificat de compétence de CEP (Inspections) si cela va à l’encontre de la Loi, du règlement, des normes ou d’une condition du certificat de compétence. [N.S. Reg. 10/2011, s. 74(2)]
- Le responsable de l’inspection en chef de CEP peut suspendre ou révoquer un certificat de compétence de CEP (Inspections) si cela va à l’encontre de la Loi, du règlement, des normes ou d’une condition du certificat de compétence. [N.S. Reg. 10/2011, s. 74(3)]
- Un certificat de compétence de CEP (Inspections) n’est pas transférable et ne peut être utilisé que par la personne à qui il a été accordé. [N.S. Reg. 10/2011, s. 75]
Le titulaire d’un certificat de compétence de CEP (Inspections) doit présenter son certificat de compétence pour examen à la demande d’un responsable de l’inspection de CEP. Si la personne ne présente pas de certificat de compétence de CEP (Inspections) lorsqu’on le lui demande, on suppose jusqu’à preuve du contraire qu’elle n’est pas titulaire d’un certificat de compétence de CEP (Inspections). Personnes aidant aux inspections
Pour qu’une autre personne l’assiste dans ses inspections, le titulaire du certificat de compétence de CEP (Inspections) doit faire ce qui suit :
- Soumettre au responsable de l’inspection en chef de CEP un programme de qualité pour les personnes aidant aux inspections et le faire accepter. [N.S. Reg. 10/2011, s. 76(1)]
- Mettre en œuvre le programme de qualité ci-dessus à la satisfaction du responsable de l’inspection en chef de CEP. [N.S. Reg. 10/2011, s. 76(2)]
- S’assurer que le titulaire du certificat de compétence de CEP (Inspections) est présent sur le site de l’inspection et participe directement à l’inspection. [N.S. Reg. 10/2011, s. 76(3)(a) and (b)]

Demande d’équivalence
- Les personnes qui détiennent un permis ou un certificat pour effectuer des travaux réglementés avec des chaudières et des appareils à pression d’une autre province ou d’un autre pays ou d’un organisme de certification reconnu peuvent demander au responsable de l’inspection en chef de CEP un permis ou un certificat équivalent. - Pour demander une licence ou un certificat équivalent, la personne qui soumet la demande doit faire ce qui suit : [N.S. Reg. 10/2011, s. 77(2)]
- Payer les frais applicables au CEP.
- Soumettre les éléments suivants au responsable de l’inspection en chef de CEP :
- Permis ou certificat valide de l’autre administration
- Et la preuve que la personne :
- possède l’expérience et les qualifications équivalentes aux exigences de la loi sur la sécurité technique (Technical Safety Act) et du règlement sur les chaudières et les appareils à pression (Boiler and Pressure Equipment Regulations) [Règlement de la N.-É. 10/2011] pour la licence ou le certificat qu’elle demande.
- Si la licence demandée est une licence pour soudage par pression, a réussi l’épreuve de compétence de soudage par pression dans la catégorie et dans les méthodes et modes opératoires de soudage et pour chaque position et plage d’épaisseur à inclure dans le champ d’activité de la licence pour soudage par pression.
Infractions

Section 33 BPE permit required
33. (1) Except as provided in subsections (2) and (4), a person must obtain a BPE permit to perform any of the following regulated work:
(a) construct a regulated product;
(b) install a regulated product;
(c) alter, repair or make additions to a regulated product;
(d) change the location of a boiler, boiler system or non-portable pressure vessel.
(2) A BPE permit is not required for routine maintenance or overhaul of a component of a pressure system if all of the following conditions are met:
(a) the routine maintenance or overhaul is included in the BPE contractor licence holder's quality program for the regulated product or regulated work;
(b) a quality program for the pressure system has been filed and accepted by the BPE chief inspector as required by subsection 53(1).
(4)* An owner of a regulated product is exempt from the requirement to obtain a BPE permit for the installation of the regulated product if the regulated product meets all of the following criteria:
(a) it was within the scope of and authorized under the Steam Boiler and Pressure Vessel Act and the Steam Boiler and Pressure Vessel Regulations made under that Act;
(b) it was installed before the date these regulations come into force.
(3)* The BPE chief inspector determines what constitutes routine maintenance or overhaul in subsection (2).

Section 34 Applying for BPE permit
34. (1) An application for a BPE permit must be accompanied by payment of the applicable BPE fees and include all of the following:
(a) a written description of the regulated work to be done;
(b) the drawings for the regulated work to be done;
(c) the particulars of the machinery and components to be used;
(d) the applicant's BPE contractor licence number.
(2) Only a BPE contractor licence holder may be granted a BPE permit.
(3) Before granting a BPE Permit, the BPE chief inspector must see and approve all of the drawings for the regulated work to be done.
(4) The BPE chief inspector may impose any terms or conditions on a BPE permit that the BPE chief inspector considers necessary.
Section 35 Displaying BPE permit while regulated work done
35. While regulated work is being done, a BPE permit holder must display the BPE permit for the regulated work at the site where it is being done.
Section 36 Expiry and renewal of BPE permit
36. (1) A BPE permit is valid until the expiry date specified on the permit unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A holder of a BPE permit that has expired or will soon expire may reapply for a BPE permit under Section 34 by submitting their BPE permit number and any information required by that Section as determined by the BPE chief inspector.
Section 37 Notifying BPE chief inspector when regulated work completed
37. A BPE permit holder must notify the BPE chief inspector when the regulated work authorized by their BPE permit is completed.
Section 38 BPE permit non-transferable
38. A BPE permit is not transferable and may be used only by the BPE contractor licence holder who is granted the permit.
Section 39 Notice of change of location of boiler, boiler system or non-portable pressure vessel
39. (1) An owner or vendor of a boiler, boiler system or non-portable pressure vessel must notify the BPE chief inspector no later than 30 days after the boiler, boiler system or non-portable pressure vessel is removed from the original location if it is relocated
(a) from within the Province to another location in the Province; or
(b) from outside the Province to a location in the Province.
(2) A notice of relocation required by clause (1)(b) must include the following:
(a) all design data and manufacturer's data for the regulated product being relocated;
(b) 1 of the following:
(i) an annual inspection record, maintenance, repair, alteration and upset record,
(ii) an inspection certificate prepared within the 6 months immediately before the regulated product entered the Province that is signed by a boiler inspector employed by the authority having jurisdiction in the jurisdiction where the boiler, boiler system or non portable pressure vessel was originally located, and details of all of the following:
(A) an internal inspection,
(B) an external inspection,
(C) a pressure test to at least the maximum allowable working pressure.
Section 40 Equipment licence required
40. A person must hold an equipment licence to use or operate a boiler, pressure vessel or refrigeration plant, or to cause or permit a boiler, pressure vessel or refrigeration plant to be used or operated.
Section 41 Applying for equipment licence
41. An application for an equipment licence must be accompanied by payment of the applicable BPE fee and include all of the following:
(a) a written description of the boiler, pressure vessel or refrigeration plant to be operated;
(b) the location of the boiler, pressure vessel or refrigeration plant to be operated;
(c) the BPE permit number for fabricating or installing the boiler, pressure vessel or refrigeration plant.
Section 42 Displaying equipment licence at location
42. An equipment licence holder must display the equipment licence with the boiler, pressure vessel or refrigeration plant that the licence authorizes to be operated or at another location approved by the BPE chief inspector.
Section 43 Expiry and renewal of equipment licence
43. (1) An equipment licence is valid until the expiry date specified on the licence unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A holder of an equipment licence that has expired or will soon expire may reapply for an equipment licence under Section 41 by submitting their equipment licence number and any information required by that Section as determined by the BPE chief inspector.
Section 44 Equipment licence non-transferable
44. An equipment licence is not transferable and may be used only by the person who is granted the licence.
Section 45 BPE contractor licence required
45. A person must not perform or employ a person to perform any of the following regulated work without a BPE contractor licence:
(a) work as a manufacturer, fabricator, installer or contractor on a regulated product;
(b) work to repair or alter a regulated product;
(c) pressure welding on a regulated product;
(d) conducting pressure welder proficiency tests;
(e) work as part of an organization involved in fabricating, installing, repairing or altering a regulated product.
Section 46 Producing BPE contractor licence on request
46. (1) A holder of a BPE contractor licence must produce their licence for review when requested by a BPE inspector.
(2) Failing to produce a BPE contractor licence when requested by a BPE inspector is prima facie evidence that the person does not hold a BPE contractor licence.
Section 47 Applying for BPE contractor licence
47. (1) An application for a BPE contractor licence must be accompanied by payment of the BPE fees and include a quality program in Section 53 acceptable to the BPE chief inspector for any regulated product or any regulated work to be carried out.
(2) The BPE chief inspector may impose any terms or conditions on a BPE contractor licence that the BPE chief inspector considers necessary.
Section 48 Keeping BPE chief inspector informed of scope of regulated work
48. A BPE contractor licence holder must keep the BPE chief inspector informed of the scope of the regulated work being carried out under their licence.
Section 49 Pressure welding procedure
49. (1) A pressure welding employer must ensure that a pressure welding procedure that meets the requirements in this Section is in place.
(2) A pressure welding procedure must be prepared, tested and certified in accordance with the BPE standards and registered with the BPE chief inspector.
(3) A pressure welding procedure that is prepared within the Province must be approved by the BPE chief inspector.
(4) A pressure welding procedure that is prepared outside the Province must be approved by the authority having jurisdiction for that jurisdiction and a record of the approval must be submitted to the BPE chief inspector.
Section 50 Pressure welding proficiency tests conducted
50. (1) A pressure welding employer must conduct a pressure welding proficiency test of each individual who is to be employed by them to perform pressure welding, using an approved pressure welding procedure and in the presence of a BPE inspector.
(2) A pressure welding employer must keep records of the data from completed pressure welder proficiency tests and have it available to be inspected if requested by a BPE inspector.
Section 51 Pressure welding employer to ensure requirements for pressure welding met
51. (1) Only a BPE contractor licence holder can be a pressure welding employer.
(2) A pressure welding employer must ensure that an employee does not perform pressure welding for them unless all of the following are met:
(a) the employee holds a pressure welder licence that authorizes the regulated work;
(b) the employer is the employer named on the welder's pressure welder licence.
(3) A pressure welding employer must not permit pressure welding to be done on any regulated product unless the requirements for pressure welding in Sections 56 to 69 are met.
Section 52 Quality of pressure welding work and welds
52. (1) The BPE inspector may require a non-destructive examination of any pressure weld or pressure welder's work that the BPE inspector considers to be of questionable quality.
(2) A BPE contractor licence holder must ensure that a defective weld identified by a non-destructive examination is repaired and its quality verified by further non-destructive examination until a BPE inspector is satisfied with the quality of the weld.
Section 53 BPE contractor licence holder quality program
53. (1) A BPE contractor licence holder must file with the BPE chief inspector a quality program for any regulated products or regulated work to be carried out and have it accepted by the BPE chief inspector.
(2) A BPE contractor licence holder must implement a quality program accepted under subsection (1) to the satisfaction of the BPE chief inspector.
(3) A BPE contractor licence holder quality program must include a written manual in which all action taken under the program is recorded.
(4) A pressure welding employer must include a method for tracking a pressure welder's history in their quality program under subsection (1).
(5) To meet the requirement in subsection (4), a pressure welding employer may create and maintain a pressure welder history log for each pressure welder in their employ to ensure the pressure welder's continuity and that a pressure welder undergoes a pressure welder proficiency test as required by Section 50.
Section 54 Expiry and renewal of BPE contractor licence
54. (1) A BPE contractor licence is valid until the expiry date provided on the licence unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A holder of a BPE contractor licence that has expired or will soon expire may reapply for a BPE contractor licence under Section 47 by submitting their BPE contractor licence number and any information required by that Section as determined by the BPE chief inspector.
Section 55 BPE contractor licence non-transferable
55. A BPE contractor licence is not transferable and may be used only by the person who is granted the licence.
Section 56 Pressure welder licence required
56. (1) A person must hold a pressure welder licence in the appropriate class to weld on any regulated product except if
(a) they are deemed to hold a licence under Section 52 of the Act; or
(b) they are exempted under subsection (2).
(2) An individual who works exclusively as a welding operator on fully automatic equipment is exempt from the requirement to have a pressure welder licence in subsection (1).
Section 58 Information on welder licence
58. A pressure welder licence must specify all of the following:
(a) the class of the licence;
(b) the scope of the work authorized by the licence, including the welding methods, processes, positions and thickness ranges;
(c) the name of the pressure welding employer the licensee is authorized to perform pressure welding for;
(d) any terms or conditions for the licence.
Section 59 Producing pressure welder licence on request
59. (1) A person conducting the work of a pressure welder must produce their pressure welder licence for review when requested by a BPE Inspector.
(2) Failing to produce a pressure welder licence that names the pressure welding employer and is of the correct class and scope of work for the work being conducting is prima facie evidence that the person does not hold the correct pressure welder licence for the work.
Section 60 Pressure welder proficiency test
60. (1) Except as provided in subsection 65(3), an applicant for a pressure welder licence must successfully complete a pressure welder proficiency test for the class and in all welding methods, processes, positions and thickness ranges to be included in the scope of practice of the licence they are applying for.
(2) A pressure welding employer must ensure that all of the following are done when conducting a pressure welder proficiency test for an applicant for a pressure welder licence:
(a) the results are recorded on the application in a format set by the BPE chief inspector;
(b) the test is conducted before establishing a pressure welder history log for the applicant;
(c) the test is witnessed and the results approved by a BPE inspector;
(d) the test is completed in accordance with the pressure welding procedure registered to the pressure welding employer under subsection 49(2);
(e) the test is completed in accordance with the BPE standards and the welding methods, processes, positions and thickness ranges are within those required for the regulated work that the pressure welding employer is authorized to perform.
(3) A BPE inspector may require a pressure welder to retake a pressure welder proficiency test if the BPE inspector questions the quality of the pressure welder's work.
Section 61 Applying for pressure welder proficiency test (pressure plate)
61. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure plate) licence must pay the applicable BPE fees and provide proof satisfactory to the BPE chief inspector that they meet the qualifications in Section 62.
Section 62 Qualifications for pressure welder proficiency test (pressure plate)
62. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure plate) licence must be employed by a pressure welding employer who holds a BPE contractor licence and must meet 1 of the following practical and educational qualifications:
(a) hold a journeyperson status in welding or an Interprovincial Standards (Red Seal) Program certificate of qualification in welding issued by the Canadian Council of Directors of Apprenticeship;
(b) have successfully completed a welding diploma program recognized by the BPE chief inspector;
(c) have completed at least 1 year of practical experience in welding;
(d) have been issued a welding qualification by a recognized certification organization for welding testing or an authority having jurisdiction for all of the welding methods, processes, positions and thickness ranges they are applying to be tested on.
Section 63 Applying for pressure welder proficiency test (pressure pipe)
63. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure pipe) licence must pay the applicable BPE fees and provide proof satisfactory to the BPE chief inspector that they meet the qualifications in Section 64.
Section 64 Qualifications for pressure welder proficiency test (pressure pipe)
64. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure pipe) licence must be employed by a pressure welding employer who holds a BPE contractor licence and must meet the following qualifications:
(a) have successfully completed a preliminary welder proficiency test conducted by a BPE inspector;
(b) 1 of the following practical and educational qualifications:
(i) hold a journeyperson status in welding or an Interprovincial Standards (Red Seal) Program certificate of qualification in welding issued by the Canadian Council of Directors of Apprenticeship,
(ii) have successfully completed a pressure pipe welding course recognized by a recognized certification organization,
(iii) have completed at least 2 years of practical experience in welding that includes open root welding,
(iv) have been issued a pressure pipe welding qualification by a recognized certification organization for welding testing or an authority having jurisdiction, for all the welding methods, processes, positions and thickness ranges they are applying to be tested on.
Section 65 Applying for pressure welder licence
65 (1) A BPE contractor may apply to the BPE chief inspector on behalf of an employee for a pressure welder licence for the employee.
(2) An application for a pressure welder licence for an individual must include the applicable BPE fees and all of the following:
(a) except as provided in subsection (3), proof that the individual has successfully completed a pressure welder proficiency test under these regulations for the class and in all welding methods, processes, positions and thickness ranges to be included in the scope of the pressure welder licence applied for;
(b) the name of the individual's pressure welding employer and the employer's BPE contractor licence number.
(3) An individual who is a qualified welder, brazer or welding operator under the Steam Boiler and Pressure Vessel Act and the Steam Boiler and Pressure Vessel Regulations on the date these regulations come into force is exempt from the requirement to take a pressure welder proficiency test under Section 60 to apply for a pressure welder licence if their application includes all of the following in addition to subsection (2):
(a) the individual's existing qualification;
(b) evidence satisfactory to the BPE chief inspector that the individual has experience equal to that required for a pressure welder proficiency test in the class and in all welding methods and processes and for each position and thickness range to be included in the scope of the pressure welder licence applied for.
Section 66 Card with information about pressure welder licence
66. The BPE chief inspector must provide a pressure welding employer named on a pressure welder's licence with a card that has information about the pressure welder licence so that the employer can make a copy of the card before giving the card to the pressure welder.
Section 67 Welding restricted to named pressure welding employer
67. (1) A pressure welder must not perform pressure welding for an employer other than the pressure welding employer named on their pressure welder licence.
(2) If a pressure welder wants to change the employer named on their pressure welder licence, the BPE contractor licence holder who is the new employer must apply to the BPE chief inspector on behalf of the pressure welder for the change.
(3) A BPE contractor licence holder applying under subsection (2) must state the welding methods and processes, positions and thickness ranges required for the regulated work that their business is authorized to perform.
Section 68 Expiry and renewal of pressure welder licence
68. (1) A pressure welder licence is valid until the expiry date specified on the licence unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A BPE contractor licence holder may apply under Section 65 to renew an employee's pressure welder licence.
Section 69 Pressure welder licence non-transferable
69. A pressure welder licence is not transferable and may be used only by the person who is granted the licence.
Section 70 BPE certificate of competency (inspections) required
70. An individual must hold a BPE certificate of competency (inspections) to be a boiler inspector and perform the regulated work of inspections for certification of boilers, pressure vessels or pressure piping systems.
Section 71 Applying for BPE certificate of competency (inspections)
71. An applicant for a BPE certificate of competency (inspections) must submit payment of any applicable BPE fees together with proof satisfactory to the BPE chief inspector of all of the following to the BPE chief inspector:
(a) that the applicant meets the qualifications in Section 72;
(b) that the applicant has sufficient education and experience with pressure equipment.
Section 72 Qualifications for BPE certificate of competency (inspections)
72. An applicant for a BPE certificate of competency must meet all of the following qualifications:
(a) they must be employed by 1 of the following:
(i) the Province or a recognized authority having jurisdiction in a jurisdiction outside the Province,
(ii) an insurance company that provides insurance coverage for boilers,
(iii) an owner or user of a regulated product who has implemented a quality program that is registered with the Province;
(b) they must meet 1 of the following experience requirements:
(i) they hold an NBBI commission or an API 510 certification through the American Petroleum Institute (API) that was issued in the 5 years immediately before their application,
(ii) they have passed either the NBBI commission exam or the API 510 certification process in the 5 years immediately before their application,
(iii) they have been recognized as a boiler standards safety officer by an authority having jurisdiction in a jurisdiction outside the Province in the 5 years immediately before their application.
Section 73 Producing BPE certificate of competency (inspections) when requested
73. (1) A BPE certificate of competency (inspections) holder must produce their certificate of competency for review when requested by a BPE inspector.
(2) Failing to produce a BPE certificate of competency (inspections) when requested is prima facie evidence that the person does not hold a BPE certificate of competency (inspections).
Section 74 Term of BPE certificate of competency (inspections)
74. (1) A BPE certificate of competency (inspections) is valid unless suspended or revoked by the BPE chief inspector.
(2) The BPE chief inspector may refuse to grant a BPE certificate of competency (inspections) if it would be contrary to the Act, these regulations, the BPE standards, or a term or condition of the certificate of competency.
(3) The BPE chief inspector may suspend or revoke a BPE certificate of competency (inspections) if the holder acts contrary to the Act, these regulations, the BPE standards, or a term or condition of the certificate of competency
Section 75 BPE certificate of competency non-transferable
75. A BPE certificate of competency (inspections) is not transferable and may be used only by the individual who is granted the certificate of competency.
Section 76 Individual assisting with inspections
76. (1) To be assisted in their inspections by an individual, a BPE certificate of competency (inspections) holder must file with the BPE chief inspector a quality program for individuals assisting in the performing of the regulated work of conducting inspections and have it accepted by the BPE chief inspector.
(2) A BPE certificate of competency (inspections) holder must implement a quality program accepted under subsection (1) to the satisfaction of the BPE chief inspector.
(3) A BPE certificate of competency (inspections) holder being assisted in their inspections by an individual must ensure that subsections (1) and (2) are complied with and that all of the following conditions are met:
(a) the BPE certificate of competency (inspections) holder is directly involved in the inspection;
(b) a BPE certificate of competency (inspections) holder is present at the site of the inspection;
(c) the individual assisting in inspections is trained in conducting inspections.
Section 77 Recognition of authorization from other jurisdiction
77. (1) An individual who holds an authorization to perform regulated work from an authority having jurisdiction in a jurisdiction outside the Province or from a recognized certification organization may apply to the BPE chief inspector for an equivalent authorization under the Act and these regulations.
(2) An individual described in subsection (1) may be granted an equivalent authorization under the Act and these regulations if the individual pays the applicable BPE fee and submits all of the following to the BPE chief inspector:
(a) a valid authorization from the other jurisdiction;
(b) proof satisfactory to the BPE chief inspector that the individual meets the following requirements:
(i) they have experience and qualifications equivalent to the requirements under the Act and these regulations for the authorization the individual is applying for,
(ii) if the licence applied for is a pressure welder licence, they have successfully completed the pressure welder proficiency test in the class and in the welding methods and procedures and for each position and thickness range to be included in the scope of work of the pressure welder licence.
Section 78 Fraudulent use of authorization
78. A person must not make fraudulent use of a certificate of competency, licence or permit under these regulations.
Section 79 Incompetence or gross negligence
79. A person who holds a certificate of competency, licence or permit under these regulations must not act incompetently or with gross negligence when acting under the authority of their certificate of competency, licence or permit.
Boiler and Pressure Equipment Regulations

Section 33 BPE permit required
33. (1) Except as provided in subsections (2) and (4), a person must obtain a BPE permit to perform any of the following regulated work:
(a) construct a regulated product;
(b) install a regulated product;
(c) alter, repair or make additions to a regulated product;
(d) change the location of a boiler, boiler system or non-portable pressure vessel.
(2) A BPE permit is not required for routine maintenance or overhaul of a component of a pressure system if all of the following conditions are met:
(a) the routine maintenance or overhaul is included in the BPE contractor licence holder's quality program for the regulated product or regulated work;
(b) a quality program for the pressure system has been filed and accepted by the BPE chief inspector as required by subsection 53(1).
(4)* An owner of a regulated product is exempt from the requirement to obtain a BPE permit for the installation of the regulated product if the regulated product meets all of the following criteria:
(a) it was within the scope of and authorized under the Steam Boiler and Pressure Vessel Act and the Steam Boiler and Pressure Vessel Regulations made under that Act;
(b) it was installed before the date these regulations come into force.
(3)* The BPE chief inspector determines what constitutes routine maintenance or overhaul in subsection (2).

Section 34 Applying for BPE permit
34. (1) An application for a BPE permit must be accompanied by payment of the applicable BPE fees and include all of the following:
(a) a written description of the regulated work to be done;
(b) the drawings for the regulated work to be done;
(c) the particulars of the machinery and components to be used;
(d) the applicant's BPE contractor licence number.
(2) Only a BPE contractor licence holder may be granted a BPE permit.
(3) Before granting a BPE Permit, the BPE chief inspector must see and approve all of the drawings for the regulated work to be done.
(4) The BPE chief inspector may impose any terms or conditions on a BPE permit that the BPE chief inspector considers necessary.
Section 35 Displaying BPE permit while regulated work done
35. While regulated work is being done, a BPE permit holder must display the BPE permit for the regulated work at the site where it is being done.
Section 36 Expiry and renewal of BPE permit
36. (1) A BPE permit is valid until the expiry date specified on the permit unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A holder of a BPE permit that has expired or will soon expire may reapply for a BPE permit under Section 34 by submitting their BPE permit number and any information required by that Section as determined by the BPE chief inspector.
Section 37 Notifying BPE chief inspector when regulated work completed
37. A BPE permit holder must notify the BPE chief inspector when the regulated work authorized by their BPE permit is completed.
Section 38 BPE permit non-transferable
38. A BPE permit is not transferable and may be used only by the BPE contractor licence holder who is granted the permit.
Section 39 Notice of change of location of boiler, boiler system or non-portable pressure vessel
39. (1) An owner or vendor of a boiler, boiler system or non-portable pressure vessel must notify the BPE chief inspector no later than 30 days after the boiler, boiler system or non-portable pressure vessel is removed from the original location if it is relocated
(a) from within the Province to another location in the Province; or
(b) from outside the Province to a location in the Province.
(2) A notice of relocation required by clause (1)(b) must include the following:
(a) all design data and manufacturer's data for the regulated product being relocated;
(b) 1 of the following:
(i) an annual inspection record, maintenance, repair, alteration and upset record,
(ii) an inspection certificate prepared within the 6 months immediately before the regulated product entered the Province that is signed by a boiler inspector employed by the authority having jurisdiction in the jurisdiction where the boiler, boiler system or non portable pressure vessel was originally located, and details of all of the following:
(A) an internal inspection,
(B) an external inspection,
(C) a pressure test to at least the maximum allowable working pressure.
Section 40 Equipment licence required
40. A person must hold an equipment licence to use or operate a boiler, pressure vessel or refrigeration plant, or to cause or permit a boiler, pressure vessel or refrigeration plant to be used or operated.
Section 41 Applying for equipment licence
41. An application for an equipment licence must be accompanied by payment of the applicable BPE fee and include all of the following:
(a) a written description of the boiler, pressure vessel or refrigeration plant to be operated;
(b) the location of the boiler, pressure vessel or refrigeration plant to be operated;
(c) the BPE permit number for fabricating or installing the boiler, pressure vessel or refrigeration plant.
Section 42 Displaying equipment licence at location
42. An equipment licence holder must display the equipment licence with the boiler, pressure vessel or refrigeration plant that the licence authorizes to be operated or at another location approved by the BPE chief inspector.
Section 43 Expiry and renewal of equipment licence
43. (1) An equipment licence is valid until the expiry date specified on the licence unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A holder of an equipment licence that has expired or will soon expire may reapply for an equipment licence under Section 41 by submitting their equipment licence number and any information required by that Section as determined by the BPE chief inspector.
Section 44 Equipment licence non-transferable
44. An equipment licence is not transferable and may be used only by the person who is granted the licence.
Section 45 BPE contractor licence required
45. A person must not perform or employ a person to perform any of the following regulated work without a BPE contractor licence:
(a) work as a manufacturer, fabricator, installer or contractor on a regulated product;
(b) work to repair or alter a regulated product;
(c) pressure welding on a regulated product;
(d) conducting pressure welder proficiency tests;
(e) work as part of an organization involved in fabricating, installing, repairing or altering a regulated product.
Section 46 Producing BPE contractor licence on request
46. (1) A holder of a BPE contractor licence must produce their licence for review when requested by a BPE inspector.
(2) Failing to produce a BPE contractor licence when requested by a BPE inspector is prima facie evidence that the person does not hold a BPE contractor licence.
Section 47 Applying for BPE contractor licence
47. (1) An application for a BPE contractor licence must be accompanied by payment of the BPE fees and include a quality program in Section 53 acceptable to the BPE chief inspector for any regulated product or any regulated work to be carried out.
(2) The BPE chief inspector may impose any terms or conditions on a BPE contractor licence that the BPE chief inspector considers necessary.
Section 48 Keeping BPE chief inspector informed of scope of regulated work
48. A BPE contractor licence holder must keep the BPE chief inspector informed of the scope of the regulated work being carried out under their licence.
Section 49 Pressure welding procedure
49. (1) A pressure welding employer must ensure that a pressure welding procedure that meets the requirements in this Section is in place.
(2) A pressure welding procedure must be prepared, tested and certified in accordance with the BPE standards and registered with the BPE chief inspector.
(3) A pressure welding procedure that is prepared within the Province must be approved by the BPE chief inspector.
(4) A pressure welding procedure that is prepared outside the Province must be approved by the authority having jurisdiction for that jurisdiction and a record of the approval must be submitted to the BPE chief inspector.
Section 50 Pressure welding proficiency tests conducted
50. (1) A pressure welding employer must conduct a pressure welding proficiency test of each individual who is to be employed by them to perform pressure welding, using an approved pressure welding procedure and in the presence of a BPE inspector.
(2) A pressure welding employer must keep records of the data from completed pressure welder proficiency tests and have it available to be inspected if requested by a BPE inspector.
Section 51 Pressure welding employer to ensure requirements for pressure welding met
51. (1) Only a BPE contractor licence holder can be a pressure welding employer.
(2) A pressure welding employer must ensure that an employee does not perform pressure welding for them unless all of the following are met:
(a) the employee holds a pressure welder licence that authorizes the regulated work;
(b) the employer is the employer named on the welder's pressure welder licence.
(3) A pressure welding employer must not permit pressure welding to be done on any regulated product unless the requirements for pressure welding in Sections 56 to 69 are met.
Section 52 Quality of pressure welding work and welds
52. (1) The BPE inspector may require a non-destructive examination of any pressure weld or pressure welder's work that the BPE inspector considers to be of questionable quality.
(2) A BPE contractor licence holder must ensure that a defective weld identified by a non-destructive examination is repaired and its quality verified by further non-destructive examination until a BPE inspector is satisfied with the quality of the weld.
Section 53 BPE contractor licence holder quality program
53. (1) A BPE contractor licence holder must file with the BPE chief inspector a quality program for any regulated products or regulated work to be carried out and have it accepted by the BPE chief inspector.
(2) A BPE contractor licence holder must implement a quality program accepted under subsection (1) to the satisfaction of the BPE chief inspector.
(3) A BPE contractor licence holder quality program must include a written manual in which all action taken under the program is recorded.
(4) A pressure welding employer must include a method for tracking a pressure welder's history in their quality program under subsection (1).
(5) To meet the requirement in subsection (4), a pressure welding employer may create and maintain a pressure welder history log for each pressure welder in their employ to ensure the pressure welder's continuity and that a pressure welder undergoes a pressure welder proficiency test as required by Section 50.
Section 54 Expiry and renewal of BPE contractor licence
54. (1) A BPE contractor licence is valid until the expiry date provided on the licence unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A holder of a BPE contractor licence that has expired or will soon expire may reapply for a BPE contractor licence under Section 47 by submitting their BPE contractor licence number and any information required by that Section as determined by the BPE chief inspector.
Section 55 BPE contractor licence non-transferable
55. A BPE contractor licence is not transferable and may be used only by the person who is granted the licence.
Section 56 Pressure welder licence required
56. (1) A person must hold a pressure welder licence in the appropriate class to weld on any regulated product except if
(a) they are deemed to hold a licence under Section 52 of the Act; or
(b) they are exempted under subsection (2).
(2) An individual who works exclusively as a welding operator on fully automatic equipment is exempt from the requirement to have a pressure welder licence in subsection (1).
Section 57 Classes of pressure welder licences
57. The 2 classes of pressure welder licences are as follows:
(a) pressure welder (pressure plate) licence;
(b) pressure welder (pressure piping) licence.
Section 58 Information on welder licence
58. A pressure welder licence must specify all of the following:
(a) the class of the licence;
(b) the scope of the work authorized by the licence, including the welding methods, processes, positions and thickness ranges;
(c) the name of the pressure welding employer the licensee is authorized to perform pressure welding for;
(d) any terms or conditions for the licence.
Section 59 Producing pressure welder licence on request
59. (1) A person conducting the work of a pressure welder must produce their pressure welder licence for review when requested by a BPE Inspector.
(2) Failing to produce a pressure welder licence that names the pressure welding employer and is of the correct class and scope of work for the work being conducting is prima facie evidence that the person does not hold the correct pressure welder licence for the work.
Section 60 Pressure welder proficiency test
60. (1) Except as provided in subsection 65(3), an applicant for a pressure welder licence must successfully complete a pressure welder proficiency test for the class and in all welding methods, processes, positions and thickness ranges to be included in the scope of practice of the licence they are applying for.
(2) A pressure welding employer must ensure that all of the following are done when conducting a pressure welder proficiency test for an applicant for a pressure welder licence:
(a) the results are recorded on the application in a format set by the BPE chief inspector;
(b) the test is conducted before establishing a pressure welder history log for the applicant;
(c) the test is witnessed and the results approved by a BPE inspector;
(d) the test is completed in accordance with the pressure welding procedure registered to the pressure welding employer under subsection 49(2);
(e) the test is completed in accordance with the BPE standards and the welding methods, processes, positions and thickness ranges are within those required for the regulated work that the pressure welding employer is authorized to perform.
(3) A BPE inspector may require a pressure welder to retake a pressure welder proficiency test if the BPE inspector questions the quality of the pressure welder's work.
Section 61 Applying for pressure welder proficiency test (pressure plate)
61. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure plate) licence must pay the applicable BPE fees and provide proof satisfactory to the BPE chief inspector that they meet the qualifications in Section 62.
Section 62 Qualifications for pressure welder proficiency test (pressure plate)
62. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure plate) licence must be employed by a pressure welding employer who holds a BPE contractor licence and must meet 1 of the following practical and educational qualifications:
(a) hold a journeyperson status in welding or an Interprovincial Standards (Red Seal) Program certificate of qualification in welding issued by the Canadian Council of Directors of Apprenticeship;
(b) have successfully completed a welding diploma program recognized by the BPE chief inspector;
(c) have completed at least 1 year of practical experience in welding;
(d) have been issued a welding qualification by a recognized certification organization for welding testing or an authority having jurisdiction for all of the welding methods, processes, positions and thickness ranges they are applying to be tested on.
Section 63 Applying for pressure welder proficiency test (pressure pipe)
63. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure pipe) licence must pay the applicable BPE fees and provide proof satisfactory to the BPE chief inspector that they meet the qualifications in Section 64.
Section 64 Qualifications for pressure welder proficiency test (pressure pipe)
64. An applicant for a pressure welder proficiency test leading to a pressure welder (pressure pipe) licence must be employed by a pressure welding employer who holds a BPE contractor licence and must meet the following qualifications:
(a) have successfully completed a preliminary welder proficiency test conducted by a BPE inspector;
(b) 1 of the following practical and educational qualifications:
(i) hold a journeyperson status in welding or an Interprovincial Standards (Red Seal) Program certificate of qualification in welding issued by the Canadian Council of Directors of Apprenticeship,
(ii) have successfully completed a pressure pipe welding course recognized by a recognized certification organization,
(iii) have completed at least 2 years of practical experience in welding that includes open root welding,
(iv) have been issued a pressure pipe welding qualification by a recognized certification organization for welding testing or an authority having jurisdiction, for all the welding methods, processes, positions and thickness ranges they are applying to be tested on.
Section 65 Applying for pressure welder licence
65 (1) A BPE contractor may apply to the BPE chief inspector on behalf of an employee for a pressure welder licence for the employee.
(2) An application for a pressure welder licence for an individual must include the applicable BPE fees and all of the following:
(a) except as provided in subsection (3), proof that the individual has successfully completed a pressure welder proficiency test under these regulations for the class and in all welding methods, processes, positions and thickness ranges to be included in the scope of the pressure welder licence applied for;
(b) the name of the individual's pressure welding employer and the employer's BPE contractor licence number.
(3) An individual who is a qualified welder, brazer or welding operator under the Steam Boiler and Pressure Vessel Act and the Steam Boiler and Pressure Vessel Regulations on the date these regulations come into force is exempt from the requirement to take a pressure welder proficiency test under Section 60 to apply for a pressure welder licence if their application includes all of the following in addition to subsection (2):
(a) the individual's existing qualification;
(b) evidence satisfactory to the BPE chief inspector that the individual has experience equal to that required for a pressure welder proficiency test in the class and in all welding methods and processes and for each position and thickness range to be included in the scope of the pressure welder licence applied for.
Section 66 Card with information about pressure welder licence
66. The BPE chief inspector must provide a pressure welding employer named on a pressure welder's licence with a card that has information about the pressure welder licence so that the employer can make a copy of the card before giving the card to the pressure welder.
Section 67 Welding restricted to named pressure welding employer
67. (1) A pressure welder must not perform pressure welding for an employer other than the pressure welding employer named on their pressure welder licence.
(2) If a pressure welder wants to change the employer named on their pressure welder licence, the BPE contractor licence holder who is the new employer must apply to the BPE chief inspector on behalf of the pressure welder for the change.
(3) A BPE contractor licence holder applying under subsection (2) must state the welding methods and processes, positions and thickness ranges required for the regulated work that their business is authorized to perform.
Section 68 Expiry and renewal of pressure welder licence
68. (1) A pressure welder licence is valid until the expiry date specified on the licence unless it is suspended or revoked earlier by the BPE chief inspector.
(2) A BPE contractor licence holder may apply under Section 65 to renew an employee's pressure welder licence.
Section 69 Pressure welder licence non-transferable
69. A pressure welder licence is not transferable and may be used only by the person who is granted the licence.
Section 70 BPE certificate of competency (inspections) required
70. An individual must hold a BPE certificate of competency (inspections) to be a boiler inspector and perform the regulated work of inspections for certification of boilers, pressure vessels or pressure piping systems.
Section 71 Applying for BPE certificate of competency (inspections)
71. An applicant for a BPE certificate of competency (inspections) must submit payment of any applicable BPE fees together with proof satisfactory to the BPE chief inspector of all of the following to the BPE chief inspector:
(a) that the applicant meets the qualifications in Section 72;
(b) that the applicant has sufficient education and experience with pressure equipment.
Section 72 Qualifications for BPE certificate of competency (inspections)
72. An applicant for a BPE certificate of competency must meet all of the following qualifications:
(a) they must be employed by 1 of the following:
(i) the Province or a recognized authority having jurisdiction in a jurisdiction outside the Province,
(ii) an insurance company that provides insurance coverage for boilers,
(iii) an owner or user of a regulated product who has implemented a quality program that is registered with the Province;
(b) they must meet 1 of the following experience requirements:
(i) they hold an NBBI commission or an API 510 certification through the American Petroleum Institute (API) that was issued in the 5 years immediately before their application,
(ii) they have passed either the NBBI commission exam or the API 510 certification process in the 5 years immediately before their application,
(iii) they have been recognized as a boiler standards safety officer by an authority having jurisdiction in a jurisdiction outside the Province in the 5 years immediately before their application.
Section 73 Producing BPE certificate of competency (inspections) when requested
73. (1) A BPE certificate of competency (inspections) holder must produce their certificate of competency for review when requested by a BPE inspector.
(2) Failing to produce a BPE certificate of competency (inspections) when requested is prima facie evidence that the person does not hold a BPE certificate of competency (inspections).
Section 74 Term of BPE certificate of competency (inspections)
74. (1) A BPE certificate of competency (inspections) is valid unless suspended or revoked by the BPE chief inspector.
(2) The BPE chief inspector may refuse to grant a BPE certificate of competency (inspections) if it would be contrary to the Act, these regulations, the BPE standards, or a term or condition of the certificate of competency.
(3) The BPE chief inspector may suspend or revoke a BPE certificate of competency (inspections) if the holder acts contrary to the Act, these regulations, the BPE standards, or a term or condition of the certificate of competency
Section 75 BPE certificate of competency non-transferable
75. A BPE certificate of competency (inspections) is not transferable and may be used only by the individual who is granted the certificate of competency.
Section 76 Individual assisting with inspections
76. (1) To be assisted in their inspections by an individual, a BPE certificate of competency (inspections) holder must file with the BPE chief inspector a quality program for individuals assisting in the performing of the regulated work of conducting inspections and have it accepted by the BPE chief inspector.
(2) A BPE certificate of competency (inspections) holder must implement a quality program accepted under subsection (1) to the satisfaction of the BPE chief inspector.
(3) A BPE certificate of competency (inspections) holder being assisted in their inspections by an individual must ensure that subsections (1) and (2) are complied with and that all of the following conditions are met:
(a) the BPE certificate of competency (inspections) holder is directly involved in the inspection;
(b) a BPE certificate of competency (inspections) holder is present at the site of the inspection;
(c) the individual assisting in inspections is trained in conducting inspections.
Section 77 Recognition of authorization from other jurisdiction
77. (1) An individual who holds an authorization to perform regulated work from an authority having jurisdiction in a jurisdiction outside the Province or from a recognized certification organization may apply to the BPE chief inspector for an equivalent authorization under the Act and these regulations.
(2) An individual described in subsection (1) may be granted an equivalent authorization under the Act and these regulations if the individual pays the applicable BPE fee and submits all of the following to the BPE chief inspector:
(a) a valid authorization from the other jurisdiction;
(b) proof satisfactory to the BPE chief inspector that the individual meets the following requirements:
(i) they have experience and qualifications equivalent to the requirements under the Act and these regulations for the authorization the individual is applying for,
(ii) if the licence applied for is a pressure welder licence, they have successfully completed the pressure welder proficiency test in the class and in the welding methods and procedures and for each position and thickness range to be included in the scope of work of the pressure welder licence.
Section 78 Fraudulent use of authorization
78. A person must not make fraudulent use of a certificate of competency, licence or permit under these regulations.
Section 79 Incompetence or gross negligence
79. A person who holds a certificate of competency, licence or permit under these regulations must not act incompetently or with gross negligence when acting under the authority of their certificate of competency, licence or permit.
